Terms and Conditions

This is a convenience translation. The contract is concluded under German law; in case of any discrepancy the German version prevails.

§ 1 Provider and scope

The provider is Keven Harder, HRT Performance, Ulmer Tal 6, 89160 Dornstadt, Germany (the “Provider”). Full provider details: Imprint.

These terms apply to all contracts for digital products concluded via https://shop.hrtperformance-ulm.de. Deviating terms of the customer do not become part of the contract unless the Provider agrees to them in writing.

§ 2 Subject matter

The subject of the contract is the supply of digital content: a control unit file uploaded by the customer is modified (“patched”) using a method developed by the Provider and made available for download together with a definition file (XDF).

  • The file is created for one specific vehicle and can only be used there.
  • Correcting the checksum is not part of the service. It is expressly carried out by the customer.
  • Writing the file to a control unit is not part of the service and is performed exclusively by the customer.
  • No particular power increase, calibration or population of the free slots is owed unless expressly stated in the product description.

§ 3 Conclusion of contract

The presentation of products in the shop is not a binding offer. The customer first uploads their file; this check is free and non-binding. Only by pressing the “Buy now” button does the customer make a binding offer. The contract comes into effect upon confirmation of payment and provision of the files.

The contract text is not stored separately. These terms and the withdrawal notice can be viewed, saved and printed from this site at any time. The language of the contract is German; this English text is a translation for convenience.

§ 4 Prices and payment

All prices are final prices. As a small business within the meaning of § 19 of the German VAT Act (UStG), the Provider does not charge VAT and therefore does not state it. There are no shipping costs.

Payment is processed by the payment service provider Stripe. The available payment methods are shown during checkout. Payment details are entered exclusively with the payment service provider and never reach the Provider’s server.

§ 5 Provision

Provision takes place immediately after receipt of payment as a browser download, and additionally by email if the customer supplied an address. The download link is valid for 7 days.

After the link expires, the customer may upload their file again; the vehicle is recognised and the download is released again free of charge. The Provider supplies later updates of the product for the same vehicle free of charge for as long as the product is offered. There is no claim to further development or to any particular period of availability.

§ 6 Licence

The customer receives a simple, unlimited in time, non-transferable right to use the supplied files for the one vehicle whose details were recorded during the order.

  • Passing on, selling, renting out or making the files publicly available is not permitted.
  • Circumventing or removing technical protection measures is not permitted.
  • Use for further vehicles requires a further purchase.
  • Your own calibration work in the free slots is expressly permitted and intended.

§ 7 Customer obligations and prerequisites

The service requires a suitable source file and suitable tools on the customer’s side. In particular, the customer is obliged to:

  • supply a file in completely stock condition — not tuned, patched or otherwise modified — obtained as a fresh, complete read from their own vehicle, including the bootloader section; files from third-party sources such as online collections are not supported;
  • create and keep a complete, verified backup of the original state before the first write operation;
  • correct the checksum with a suitable tool before writing;
  • keep a working recovery path (e.g. boot mode / BDM) available;
  • observe the instructions in the readme supplied with the files.

By uploading a file the customer confirms that they are entitled to use it.

§ 8 Intended use, liability

The content offered is intended for use outside public roads. Modifications to control unit software may impair or void the vehicle’s operating licence (§ 19 StVZO in Germany, equivalent provisions elsewhere) and may affect insurance cover and manufacturer warranty. Compliance with the rules applicable at the place of use is the sole responsibility of the customer.

Writing modified software to a control unit may render it permanently inoperable and may cause damage to the engine and drivetrain. The customer bears this risk.

The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In cases of simple negligence the Provider is liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

§ 9 Defects

The statutory provisions of §§ 327 et seq. of the German Civil Code apply to digital products. In particular, there is no defect if

  • the customer did not correct the checksum, or corrected it incorrectly;
  • the customer made their own changes in the free slots that cause the behaviour complained of;
  • the control unit hardware or the vehicle itself is faulty;
  • the source file used did not belong to the vehicle, or was not in stock condition.

Before reporting a defect, the Provider asks for the corresponding data logs and the file used — without them a defect cannot be distinguished from a calibration or hardware problem.

§ 10 Right of withdrawal

Consumers have a right of withdrawal as set out in the withdrawal notice. For digital content it expires early if the customer has expressly consented to performance beginning before the withdrawal period ends and has acknowledged losing the right of withdrawal thereby. This consent is obtained separately during checkout.

§ 11 Dispute resolution

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

German law applies. Towards consumers this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of residence. Should any provision be invalid, the validity of the remaining provisions is not affected.
